18 Wheels & Accidents

Big rig, tractor trailer, semi, semi trailer...whatever you want to call it, the fact is that while most cars weigh between 3,000 and 4,000 pounds, a truck can weigh 80,000 pounds. And unfortunately, if these vehicles are involved in an accident, the result to the car driver is more often than not, serious injury or death.

According to the U.S. Department of Transportation, there are over 5,000 fatal accidents involving 18 wheelers each year. Additionally, one of every fatal car accident is caused by a semi. So what is being done to bring these startling statistics down? Safety, maintenance and federal regulations have been put into place and if you have ever driven down the highway, you have noticed the truck checkpoint areas. Highway check points are a way for law enforcement to make sure that not only the truck, but the driver as well, is safe to be on the road. But still, accidents do happen. The Eshelman Legal Group in Cuyahoga Falls, Ohio ( with offices throughout N.E. Ohio ) has had to represent many individuals and families who have been involved in 18 wheeler accidents.

Of course there is always driver error, but some of the other factors that may play a part in an serious accident are:

  • Maintenance; Was the tire pressure correct? Was the tire tread sufficient? Were the brakes in full working order (brake maintenance standards)? Were all the lights working?
  • Documentation; Were all permits, log books and driver’s licenses in order and up to date?
  • Compliance; Have the STRICT rules about how many hours a driver is allowed to be on the road daily and weekly been followed? Truck drivers may not exceed working 70 hours per week and daily they are only allowed to be on duty 14 hours. Of those 14 hours, they can only drive 11 hours and once 14 hours on duty have been reached, the driver MUST take 10 consecutive hours off. To ensure these limits are followed, drivers are required to keep a record log which is often electronically done. These logs are always sent to the trucking company who can get audited by the federal government. They can also be looked at by officials at roadside inspection points. That said, it is very important for truckers to stay in compliance with this regulation.
  • Speed Limits; Does the truck have a speed limit cap on it which limits the speed to around 68 mph?
